MOTIK respects the privacy of anyone whose personal data is processed by MOTIK, including visitors to the website www.motik.nl (hereinafter: "the website"). MOTIK considers careful handling of personal data to be of great importance. MOTIK will process your personal data in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016).
MOTIK processes personal data based on the following four legal grounds:
1.     For the execution of an agreement between you and MOTIK or your request to enter into such an agreement.
This ground applies when you use the services of MOTIK or, for example, have requested a quote for them.
In the context of this legal basis for processing your personal data, MOTIK processes your personal data only if and to the extent that it is necessary for the execution of the agreement concluded with you. In this context, your personal data may also be shared with third parties to the extent that it is necessary for the execution of the relevant agreement, such as with third-party service providers with whom MOTIK cooperates in providing the agreed services.
2.     A legitimate interest of MOTIK.
This ground applies in case of:
a)      the automatic provision by MOTIK of your personal data to the hosting party engaged by MOTIK that enables the functioning of the website. This is necessary for storing the personal data processed via the website and to ensure the proper functioning of MOTIK's website and email facilities;
b)     the use of a CRM system for storing customer data;
c)      the use of chat software to enable the use of the relevant messaging function;
d)     the use of cloud services, such as Google Drive, for data storage, including personal data.
The operators of the software referred to in b), c), and d), the system, or cloud services store relevant personal data to offer the functionalities of the software, the system, or cloud services to MOTIK.
In the context of 'legitimate interests,' MOTIK processes your personal data only if and to the extent that it is necessary to serve the relevant legitimate interests.
3.     Your consent.
This ground applies when:
a)      you contact MOTIK by phone, email, via the contact form on the website, or through any other means, or when you subscribe to receive newsletters. Your consent is implicitly contained in the fact that you contact us or subscribe to receive newsletters;
b)     you have given permission, for example through a release consent, to use visual material in which you are depicted for certain purposes;
c)      you have given permission to post your review on the website;
d)     MOTIK wants to use your personal data for other purposes or disclose them to third parties. In this context, your consent always applies to a specific processing and a specific purpose. If MOTIK has multiple purposes for processing personal data, MOTIK will inform you about this and ask for your consent for each purpose separately.
In this context, MOTIK processes your personal data only if and to the extent that it is necessary to process your request or to carry out what you have consented to.
If you have subscribed to receive newsletters, you can unsubscribe from further reception of these messages in the manner indicated in the respective messages.
4.     A legal obligation.
This ground applies when MOTIK must comply with a legal obligation, such as storing invoices and payroll records for seven years as prescribed by law.
European Economic Area
MOTIK stores your personal data within the European Economic Area ("EEA"). However, it may occur that certain personal data collected by MOTIK are transferred to or stored outside the EEA because an external service provider of MOTIK is located there. When this is the case, MOTIK ensures that the processing of your personal data outside the EEA is carried out in a safe and lawful manner. MOTIK will therefore take the necessary steps to ensure that your personal data is adequately protected.
Access to personal data
Only authorized employees of MOTIK have access to your personal data, and only to the extent necessary for the performance of their assigned duties. This also applies concerning third parties as mentioned above with whom MOTIK shares personal data. MOTIK will under no circumstances sell your personal data. The persons operating under the responsibility of MOTIK, as well as third parties engaged by MOTIK, are obliged to respect the confidentiality of your personal data. To the extent MOTIK outsources the processing of personal data to a third party, MOTIK will take the necessary steps to ensure that your personal data is adequately protected. Such steps include, if and to the extent required by law, employing a data processing agreement with these recipients to ensure that they take the same or similar technical and organizational measures as MOTIK, so that your personal data is adequately protected.

MOTIK uses functional, analytical cookies, marketing cookies, and similar techniques (such as Google Analytics and Facebook Pixel, which can automatically collect data when you visit the website). Your rights
You have the right to request MOTIK for access, deletion, and rectification of your personal data and to restrict processing concerning you. You also have the right to object to processing and have the right to data portability. This means you can request MOTIK to send the personal data processed by MOTIK, in a computer file, to you or an organization specified by you.
To ensure that the request has been made by you, MOTIK requests that you send a copy of your identity document along with the request. In this copy, make the MRZ (machine readable zone, the strip with numbers on the document), document number, and Citizen Service Number (BSN) black. This is to protect your privacy. MOTIK will respond to your request as soon as possible, but in any case within four weeks.
Insofar as the processing of personal data is based on the consent you have provided, you have the right to withdraw this consent at any time, without affecting the lawfulness of the processing based on the consent before its withdrawal.
You have the right to file a complaint with the Data Protection Authority or, if you reside in a country other than the Netherlands, the supervisory authority there.
Retention of personal data
Personal data is only retained by MOTIK as long as it is necessary in view of the purposes for which they were obtained. MOTIK implements appropriate technical and organizational measures to secure personal data against loss and any form of unlawful processing. These measures ensure, considering the state of the art and the costs of implementation, an appropriate level of security given the risks the processing and the nature of the personal data to be protected entail. The measures are also aimed at preventing unnecessary processing of personal data.
